Protection of human participants is a fundamental facet of biomedical research. We report the activities of a health service research study in which there were three institutional review boards (IRBs), three legal departments and one research administration department providing recommendations and mandating changes in the study methods. Complying with IRB requirements can be challenging, but can also adversely affect study outcomes. Multiple protocol changes mandated from multiple IRBs created a research method that was not reflective of how substance use screening (...) would be performed in a clinical setting. There was direct conflict between the IRBs' perceptions of participants' protection with the researchers' need to use research methodology that assures the clinical relevancy of results. (shrink)

Sister (Sr.) Marie Simone Roach, of the Sisters of St. Martha of Antigonish, Nova Scotia, died at the Motherhouse on 2 July 2016 at the age of 93, leaving behind a rich legacy of theoretical and practical work in the areas of care, caring and nursing ethics. She was a humble soul whose deep and scholarly thinking thrust her onto the global nursing stage where she will forever be tied to a central concept in nursing, caring, through her Six (...) Cs of Caring model. In Canada, she was the lead architect of the Canadian Nurses Association's first code of ethics, and her influence on revisions to it is still profound more than 35 years later. In this paper, four global scholars in nursing and ethics are invited to reflect on Sr. Simone's contribution to nursing and health‐care, and we link her work to nursing and health‐care going forward. It is suggested that consciousness is primarily associated not with stimuli and perception, as commonly supposed, but with movement and responses. Consciousness of stimuli arises in situations in which possible movements are planned, or in which information must be actively acquired rather than passively registered, and may or may not require overt movements to be performed. By emphasizing response, this formulation provides a simple explanation for the perceived unity of consciousness: though stimuli can be diverse, with independent components, movements must (...) necessarily be coordinated. Therefore, if we are to look for a `site' for consciousness, it is likely to be in a region such as the anterior cingulate that is neurally close to the higher motor hierarchical levels, and also accessible both to real sensory feedback and also to virtual feedback derived through mechanisms of efference copy from actual or proposed motor commands. It is suggested that synchrony of arrival of such information may be an important prerequisite of this unity, and that on this basis such a `master node' might be expected to be temporally `equidistant' from each of these sources; this may well be true of the anterior cingulate, but no doubt also of other structures. International business organizations are regularly addressed on their corporate social responsibility (CSR). As illustrated in this paper, it is not yet clear exactly what CSR means to organizations and how to deal with it. In this paper, the authors explore how a sensemaking approach helps to understand the business challenges of CSR within an organizational context. The theories of Karl Weick are applied to the experiences of CSR in Royal Dutch Shell. The authors argue that the key to CSR in (...) international business organizations is to engage stakeholders and start a process of joint sensemaking. Three main competencies are crucial in this: the competency to engage stakeholders through listening and understanding; the creation of an organizational language so that CSR makes sense to members of the organization; and recognizing the momentum of taking action. Einstein’s razor, a corollary of Ockham’s razor, is often paraphrased as follows: make everything as simple as possible, but not simpler. This rule of thumb describes the challenge that designers of a legal system face—to craft simple laws that produce desired ends, but not to pursue simplicity so far as to undermine those ends. Complexity, simplicity’s inverse, taxes cognition and increases the likelihood of suboptimal decisions. In addition, unnecessary legal complexity can drive a misallocation of human capital toward comprehending and (...) complying with legal rules and away from other productive ends. While many scholars have offered descriptive accounts or theoretical models of legal complexity, most empirical research to date has been limited to simple measures of size, such as the number of pages in a bill. No extant research rigorously applies a meaningful model to real data. As a consequence, we have no reliable means to determine whether a new bill, regulation, order, or precedent substantially effects legal complexity. In this paper, we begin to address this need by developing a proposed empirical framework for measuring relative legal complexity. This framework is based on “knowledge acquisition”, an approach at the intersection of psychology and computer science, which can take into account the structure, language, and interdependence of law. We then demonstrate the descriptive value of this framework by applying it to the U.S. Code’s Titles, scoring and ranking them by their relative complexity. We measure various features of a title including its structural size, the net flow of its intra-title citations and its linguistic entropy. Our framework is flexible, intuitive, and transparent, and we offer this approach as a first step in developing a practical methodology for assessing legal complexity. (shrink)

The first brief description is given of a project aimed at searching for the neural correlates of consciousness through computer simulation. The underlying model is based on the known circuitry of the mammalian nervous system, the neuronal groups of which are approximated as binary composite units. The simulated nervous system includes just two senses - hearing and touch - and it drives a set of muscles that serve vocalisation, feeding and bladder control. These functions were chosen because of their relevance (...) to the earliest stages of human life, and the simulation has been given the name CyberChild. The system's pain receptors respond to a sufficiently low milk level in the stomach, if there is simultaneously a low level of blood sugar, and also to a full bladder and an unchanged diaper. It is believed that it may be possible to infer the presence of consciousness in the simulation through observations of CyberChild's behaviour, and from the monitoring of its ability to ontogenetically acquire novel reflexes. The author has suggested that this ability is the crucial evolutionary advantage of possessing consciousness. The project is still in its very early stages, and although no suggestion of consciousness has yet emerged, there appears to be no fundamental reason why consciousness could not ultimately develop and be observed. This book critically analyses experiences with bioethics education in various countries across the world and identifies common challenges and interests. It presents ethics teaching experiences in nine different countries and the basic question of the goals of bioethics education. It addresses bioethics education in resource-poor countries, as the conditions and facilities are widely different, and set limits and provide challenges to bioethics educators. Further, the question of how bioethics education can be improved is explored by the contributors. Despite the volume (...) of journal publications agreement on bioethics education is rather limited. There are only few examples of core curricula, demonstrating consensus on the contents, goals, methods and assessment of teaching programs. We need ask: How can agreement on the best modalities of bioethics education be promoted? (shrink)

Gerhard Ebeling on faith. Gerhard Ebeling (1912–2001), not only the foremost Luther researcher of the previous century but also one of the most prominent contributors to protestant theology during that period, wrote extensively about faith throughout his long and productive life as a professional theologian. He learnt from Luther that discerning judgement in the differentiation of related matters forms the basis of all sound theology. Applying this insight to his own thought, he reflects on the development of the phenomenon of (...) faith in the Old Testament community and early Christianity and the formalisation of the concept for use in the domain of religious studies. He defends the argument that Christian faith is not only faith in Jesus as the Christ and Lord but also that Jesus, and He only, is the founder and perfecter of faith. The concept of faith is also explored by Ebeling in relation to love, life and reason. The article concludes with a critical evaluation of Ebeling’s contribution in guiding us to witness authentically about our own faith in Jesus Christ within our own situation and against the background of the problems it poses for believing in Christ. The gospel is not a new law. A clear distinction must be made between law and gospel, so that the gospel is not mistakenly understood as a new law, but as the gospel. The relationship between law and gospel must be considered carefully. Two prominent theologians, Martin Luther and Karl Barth, did just that, but in opposition to one another. This article describes and compares their respective views. Barth defends a political use of the gospel. The gospel provides believers with (...) action instructions for the civilian life. Barth argues in terms of analogical thinking and, according to him, believers’ understanding of reality is determined by their understanding of Christ. Luther, on the other hand, believes that the preaching of Christ and the life experience are in contrast. Faith and life are not identical. He understands the believer as the hearer of the gospel – as passive recipient of the grace of God. The passivity here, however, is a highly creative one. The relevance for us of the theological position defended regarding law and gospel is evident from the document ‘Association of the World Communion of Reformed Churches with the Joint Declaration on the Doctrine of Justification’. The spirit of the document is clearly Barthian. Fundamental theological differences are on the table with the Lutheran position and there is no question of real consensus. Intensive study and frank ecumenical conversation is required to seek real consensus for the sake of a clear Christian testimony in the world. (shrink)

Rudolf Bultmann was one of the leading thinkers within an influential theological direction that arose in Europe after the First World War, known as dialectical theology. Comprehensive introductions to the life and work of Bultmann in the South African theological journals, written in Afrikaans, either does not exist, or are difficult to trace for the Afrikaans readership. This article on Bultmann aims to fill the gap by offering a lexicographical contribution on the life and work of Bultmann. The focus of (...) this article is on Bultmann as a Lutheran thinker. The theme of the New Testament and systematic theology is essentially the same, namely to explain the concept of Christian self-understanding as an eschatological event in which faith is expressed for the sake of faith in God and only in God. Bultmann explained the same theological concepts with his theology as those that were explained by the church reformers of the 16th century, but under radically new circumstances. The so-called modern and postmodern people of our time not only broke ties with the past, but in the process they also lost their ability for using historical-critical patterns of thought that tries to bridge historical distances, and therefore sacrificed all efforts to think systematically on the altar of relativism. We can learn from Bultmann what systematic reformed theology really is. (shrink)

The Venerable John Henry Cardinal Newman seemingly had the “Midas touch” in reverse. Oxford, Littlemore, Dublin were all sites of failures; the “Achilli Affair” was a humiliation; the quarrel with Faber was an embarrassment. Nonetheless, most people today think of Newman as a rousing success story. Why? Newman serves as an object lesson in living the Paschal Mystery, whereby each moment of crisis can be transformed into a moment of grace.

Arguments by Utpaladeva and Abhinavagupta for evidence of a Self that is one and the same as the Great Lord Śiva are interpreted. The views of these authors are clarified and the contradictory relationship between the limited individual subject and the recognition of the true Self is shown. With the help of Utpaladeva's distinction between "seeing" and "noticing," a further interpretation is attempted. Some remarks are made concerning practical meditation and the theoretical presuppositions of this way of thinking in order (...) to find starting points for a comparison with Western philosophy. Recent conjectures regarding the nature and mechanism of consciousness are extended to include the contribution of the cerebellum. The role of this brain structure appears to be a rather sophisticated form of prediction, as exemplified by certain dynamical capabilities of the visual system, and by the difficulty of self-administered tickling. The pars intermedia of the cerebellum is perceived as a direct feedback device, functioning in parallel to the primary neuronal circuit involved in consciousness; this leads to the suggestion that it (...) serves as a tutor for the putative master node, the latter governing the collective movements of all the body's muscles. The cerebellar hemispheres are believed to act as an internal feedback device, and to be more directly coupled to the master node; they are seen as serving plenisentient unconsciousness. The possible importance of muscular spindles for the generation of qualia is discussed, as are the significance of the frontal lobes, the basal ganglia and the limbic system for the content of consciousness. Finally, the stages through which infant consciousness gradually acquires its sophistication are tentatively identified. (shrink)
